Flickr Sold; Terms Changing.

"You retain all intellectual property rights in and to any User Content you post, upload or otherwise make available through the Services, including the copyright in and to your photos and videos. SmugMug does not claim any ownership, right, title or interest in and to your User Content.
Notwithstanding the foregoing, by uploading and/or posting any User Content to the Services, you grant SmugMug a perpetual, nonexclusive and royalty-free right to use the User Content (and the user name that is submitted in connection with such User Content) as is reasonably necessary in order to enable SmugMug to provide the Services, including to display the User Content on the Services."

I don't remember that 2nd paragraph; I think the old terms said you gave them a license to use your content as long as you used the service, not forever. Guess I'll have to close my account...

Is it me, or is that complete double speak. You retain all intellectual property rights...except once you upload it you lose what amounts to all your intellectual property rights. That's like - you own this car, except I can use it whenever I want or let anyone else use it whenever they want, for free, and oh, and if there are any problems that come from using the car, then its *your* car.

That last clause ("including to display the User Content on the Services") is such an obvious smoke screen. It's pretty clear how reasonably "reasonably necessary" is going to be interpreted.

Sad thing is, almost all other photo sites have similar terms; the main reason I chose Flickr is because they didn't require a perpetual license.

Already deleted my account, by the way.
